Weed No Way but Concealed Weapons are OK. Legal medical marijuana patients may NOT carry medical marijuana from state-to-state.

Legal Reciprocity

Legal reciprocity is common for many licenses, like drivers licenses for example.

If you have a valid NJ drivers license, you can legally drive in any state. Unfortunately, medical marijuana cards do not share this same protection.

Reciprocity For Medical Marijuana Laws

Medical marijuana reciprocity is where other states legally recognize and respect the medical marijuana patient status from another state. This protects the rights of medical marijuana patients if they need to travel within these states.

Without medical marijuana reciprocity, patients risk being arrested and sent to prison for carrying their medication.

Most States Do Not Have Medical Marijana Reciprocity

As a NJ patient, I can only travel to a few states and use my medication without fearing legal prosecution and/or prison time. (Scroll down for a full list.)

 

Lack Of MMJ Reciprocity Is A Hardship For Patients

  • The lack of medical marijuana reciprocity is a hardship for patients living in small states.
  • It’s risky for patients who live near state borders and who frequently need to cross into another state (and also may do so without realizing).
  • It’s a major hardship for those who work in other states or have family out of state.

I hate the lack of medical marijuana law reciprocity because it prevents me from attending many of my son’s games and tournaments.

If I want to watch my son play hockey in PA (even though its less than an hour from my house), I have to either take deadly opiates and/or valium, or risk prison for bringing MMJ.

Concealed Carry Reciprocity Approved

This really pisses me off. The House passed a bill that granted gun owners reciprocity to carry concealed weapons in any state.

So, if you have a concealed weapons permit in one state, it’s perfectly ok for you to carry that concealed weapon to ANY state you choose in the US.

Permit owners for concealed weapons are allowed to carry to other states. Medical marijuana patients are not.

Impassioned Plea For An Arrested Gun-Slinger

On the floor of the house, Rep. Richard Hudson, made an impassioned plea, noting the hardship of one gun-toting woman who traveled from PA to NJ, ignoring the law and carrying her concealed weapon.

CNN reports:

North Carolina GOP Rep. Richard Hudson, the author of the bill, recounted a story on the House floor about a woman from Pennsylvania with no criminal record who held a concealed carry permit for her pistol, which was not recognized when she traveled to New Jersey, and was later jailed.
“Are you serious? We have to make sure that never happens again,” Hudson said. He compared concealed carry permits to marriage licenses or divorce decrees, and drivers’ licenses, which are recognized in other states.

 

Now I’m not trying to make light of anyone’s hardship, but guys, we’re talking about a concealed DEADLY weapon. I can’t take my medication, but she can bring a gun? WTF?

Medical marijuana laws need reciprocity.

MMJ Patients Are Being Imprisoned

Clearly, GOP Rep Hudson must not realize how many medical marijuana patients are harassed and jailed in PA and other unfriendly states around the county, EVEN when they’re legal patients in their home state.

Rep Hudson, PROTECT US!!  Make sure it never happens to patients again.  Let’s make sure “this never happens again!” to patients who are suffering.

Gun Deaths VS Marijuana Deaths

This isn’t about gun control, this is about the absurd juxtaposition. 

33,000 Americans are killed by guns every year. 33,000!!!!  Yet, it is now perfectly legal for people to carry concealed weapons from state to state.

Marijuana has NEVER killed ANYONE.

No one has died from a marijuana overdose. Yet, some states still send MMJ patients to prison.

States with Legal Recreational Cannabis Laws

Out of state medical marijuana patients have some protections in these states.

Arizona Patients who are protected under other states’ medical marijuana laws and who have conditions that qualify under Arizona law may possess marijuana in the state

Colorado All adults 21 and up may possess and purchase marijuana
Delaware Patients who are protected under other states’ laws and who have conditions that qualify under Delaware law may possess marijuana in the state
D.C. All adults 21 and up may possess marijuana, DC is considering a medical reciprocity law
Maine Patients who are protected under other states’ medical marijuana laws may possess marijuana in the state
Nevada Patients who are protected under other states’ laws may possess and purchase medical marijuana; they must sign an affidavit to qualify
New Hampshire Patients who are protected under other states’ laws and who have conditions that qualify under New Hampshire law may possess marijuana in the state
Oregon Non-residents may get Oregon medical marijuana ID cards; in addition, any adult 21 or older may possess marijuana and may purchase marijuana once stores open
Rhode Island Patients who are protected in other states may possess medical marijuana in the state
Washington All adults 21 and up may possess and purchase marijuana

Conclusion

If you’re traveling out of state as a medical marijuana patient, BE SURE to check the marijuana laws for the states you’ll be traveling to AND through.

However, if you have a concealed weapon, you’re good, feel free to carry that deadly object wherever the hell you please.
